ASSUMPTION OF RISK, RELEASE OF LIABILITY, AND PARTICIPATION AGREEMENT
Titans Regiment
By participating in Titans Regiment programs, activities, events, challenges, rank evaluations, coachingservices, online training, in-person training, or related activities, the participant acknowledges and agrees tothe following:
1. Voluntary Participation
I understand that participation in Titans Regiment is voluntary.
I choose to participate of my own free will and accept full responsibility for my decision to engage inphysical training and related activities.
2. Assumption of Risk
I understand that physical training involves inherent risks, including but not limited to:
Muscle strains and sprains Joint injuries. Tendon and ligament injuries. Bruising and abrasions. Falls and Heat-related illness, Dehydration, Equipment-related injuries. Overexertion, Cardiovascular events, Temporary or permanent disability. Serious injury, Death.
I further understand that Titans Regiment training may include activities such as:
Running, Sprinting, Hill training, Rucking, Bodyweight training, Weighted calisthenics, Sandbag training, Odd-object lifting, Loaded carries, Obstacle training, Outdoor field training.
Rank evaluations, Physical challenges, Independent workouts, Future training activities introduced by Titans Regiment
I knowingly and voluntarily assume all risks associated with participation.
3. Physical Condition and Medical Responsibility
I certify that I am at least eighteen (18) years of age.I affirm that I am physically capable of participating in training activities.I understand that Titans Regiment is not a medical provider and does not provide medical advice, diagnosis,or treatment.I acknowledge that I should consult a physician or qualified healthcare professional before participating inany exercise program.I agree to immediately discontinue participation and seek medical attention if I experience symptoms thatmay indicate injury, illness, or medical distress.
4. Independent Training
I understand that many Titans Regiment activities may be performed independently without directsupervision.I accept full responsibility for my actions, decisions, training environment, equipment selection, andexercise execution during independent workouts.Titans Regiment cannot monitor every participant at all times and cannot guarantee participant safety.
5. Outdoor and Environmental Conditions
I understand that training may occur indoors, outdoors, at home, in commercial gyms, in public parks, onprivate property, or at other locations.
I acknowledge that environmental conditions may include:Uneven terrainWeather conditionsWildlifeNatural obstaclesTraffic hazardsSurface hazardsOther unforeseeable conditionsI voluntarily assume all risks associated with these environments.
6. Emergency Medical Authorization
In the event of a medical emergency occurring during an instructor-led activity, I authorize Titans Regiment,its instructors, staff, representatives, or emergency responders to obtain emergency medical treatmentdeemed reasonably necessary.I understand that I am solely responsible for any medical expenses incurred.
7. Release of Liability
To the fullest extent permitted by law, I release, waive, discharge, and hold harmless Titans Regiment, itsowners, instructors, coaches, employees, contractors, volunteers, affiliates, successors, and assigns fromany and all claims, liabilities, demands, causes of action, damages, losses, costs, or expenses arising from orrelated to my participation.This release applies whether such claims arise from negligence or otherwise, except where prohibited bylaw.
8. Future Programs and Activities
I understand that Titans Regiment may introduce new training methods, equipment, challenges,evaluations, programs, events, or activities in the future.By continuing participation, I acknowledge and accept the inherent risks associated with such activitiesunless otherwise stated.
9. Arbitration Agreement
Any dispute, claim, or controversy arising from participation in Titans Regiment shall be resolved exclusivelythrough binding arbitration.
The arbitration shall be conducted in the State of Montana and governed by Montana law.The participant waives the right to trial by jury and agrees not to pursue claims through class actionproceedings.Each party shall bear its own legal fees unless otherwise determined by the arbitrator.
10. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of Montanawithout regard to conflict of law principles.
11. Severability
If any provision of this Agreement is found unenforceable, the remaining provisions shall remain in fullforce and effect.
12. Acknowledgment
I have read this Agreement in its entirety.I understand its contents.
